By accessing or using August ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

August is operated by Superneural Technologies Private Limited ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

August is an AI-powered business assistant that runs on a cloud computer and helps users perform growth work across research, lead generation, outreach preparation, reporting, content generation, and recurring workflows. The Service includes:

• AI-assisted research, writing, and analysis
• Cloud computer, file, browser, and tool workflows
• Connected channels, integrations, and automations
• Generation of reports, messages, images, media, and other outputs
• Cloud storage for user content and generated outputs

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account

You must be at least 18 years old to create an account and use the Service.

4. Subscription and Payments

August offers various subscription plans with different features, usage limits, channels, automations, and generation allowances. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Refunds are handled on a case-by-case basis as described in our Refund Policy
• You may cancel your subscription at any time through your account settings

5. Acceptable Use Policy

• Generate deepfakes or misleading content intended to deceive
• Impersonate real individuals without their explicit consent
• Send spam, unlawful outreach, or messages that violate applicable platform rules
• Scrape, access, or process data in ways you are not authorized to perform
• Create content that violates intellectual property rights
• Generate adult, sexually explicit, or pornographic content
• Produce content promoting violence, discrimination, or hate speech
• Circumvent usage limits or abuse the Service
• Reverse engineer or attempt to extract source code from the Service

Violation of this policy may result in immediate account termination without refund.

6. Intellectual Property

Your Content

You retain ownership of the prompts, files, business information, connected-account content, and other materials you input into the Service. By using the Service, you grant us a limited license to process your content solely for providing, securing, and improving the Service.

Generated Content

Outputs generated through August are owned by you, subject to these Terms and any third-party rights or restrictions that may apply to your inputs, connected tools, or downstream use. You receive a perpetual, non-exclusive license to use generated outputs for commercial and personal purposes.

Our Content

The Service, including software, user interfaces, workflows, prompts, models, infrastructure, and platform features, remains our exclusive property. You may not copy, modify, or distribute any part of the Service without written permission.

7. AI-Generated Content Disclaimer

Content generated by August is created using artificial intelligence. You acknowledge that:

• AI-generated content may not always be accurate or error-free
• You are responsible for reviewing and editing generated content before use
• AI outputs may contain factual mistakes, outdated information, or incomplete analysis
• You are responsible for decisions, communications, and actions you approve or take based on generated outputs
• The Service does not provide legal, financial, medical, tax, or other professional advice
• You must comply with applicable laws regarding AI-generated content disclosure

8. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

We do not use your content (including prompts, uploads, connected account content, business context, or generated outputs) to train AI models.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
• WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE

10. Indemnification

You agree to indemnify and hold harmless August, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and associated data
• You remain liable for any outstanding payments

12. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ahmedabad, India.
